1. General Principle

Due to the nature of second-hand construction equipment, all sales made by M.L TRACTOREN EN MACHINES are considered final, unless otherwise expressly agreed in writing.

2. "As Is" Sales

All equipment is sold on an "as is, where is" basis, with all existing faults, whether visible or hidden, to the fullest extent permitted by applicable law.

The Buyer acknowledges having had the opportunity to inspect the equipment or request sufficient information prior to purchase.

3. No Right of Withdrawal

Business-to-business (B2B) transactions are not subject to consumer withdrawal rights. Therefore, no right of withdrawal or cancellation applies once an order has been confirmed.

4. Non-Refundable Payments

All payments made are non-refundable, including but not limited to:

deposits
advance payments
full purchase amounts

unless explicitly agreed otherwise in a written contract signed by both parties.

5. Exceptions

Refunds may only be considered under the following strictly limited circumstances:

proven material misrepresentation by the Seller
delivery of equipment fundamentally different from what was contractually agreed

In such cases, the Seller reserves the right to:

repair the equipment, or
replace the equipment (if possible), or
issue a partial refund at its sole discretion

6. Claims Procedure

Any claim must be submitted:

in writing within 96 hours from delivery or collection
supported by clear evidence (photos, videos, documentation)

Failure to comply with this procedure results in automatic rejection of the claim.

7. Return Conditions (If Accepted)

If a return is exceptionally accepted in writing:

the equipment must be returned in the same condition as delivered
no additional usage or damage is permitted
all transport and associated costs are borne by the Buyer

8. Transport and Risk

The Seller is not responsible for damage occurring during transport when the transport is arranged by the Buyer.

If transport is arranged by the Seller, liability is limited to the terms agreed with the transport provider.

9. Limitation of Liability

To the maximum extent permitted by law, the Seller shall not be liable for:

loss of profit
loss of business
indirect or consequential damages

10. Governing Law

This Refund Policy shall be governed by and interpreted in accordance with the laws of the Netherlands.

11. Final Provisions

This policy forms an integral part of the Terms and Conditions and applies to all transactions unless otherwise agreed in writing.
