TERMS AND CONDITIONS
1. General Information
These Terms and Conditions govern the use of services and the purchase of second-hand construction equipment from M.L TRACTOREN EN MACHINES, a company registered in the Netherlands, with its registered office at DORPSVAART 00009 1648LZ DE GOORN, hereinafter referred to as the "Seller".
By accessing the offers and placing an order, the client fully accepts these Terms and Conditions.
2. Subject of the Contract
The subject of the contract is the sale of second-hand construction equipment, including but not limited to: excavators, bulldozers, cranes, wheel loaders, and other similar machinery.
3. Condition of Equipment
All equipment sold is second-hand and may show signs of wear and tear.
The Seller makes reasonable efforts to accurately describe the technical and visual condition of the equipment but does not guarantee the absence of hidden defects.
The Client is responsible for inspecting the equipment prior to purchase or requesting additional information.
4. Prices and Payment
All prices are expressed in EUR and may or may not include VAT, depending on the Client’s fiscal status.
Payment can be made via:
bank transfer
other methods agreed in writing
Equipment will be delivered only after full payment has been confirmed.
5. Delivery and Transport
Delivery of equipment may be carried out by:
collection by the Client
transport arranged by the Seller
Transport costs are borne by the Client unless otherwise agreed.
Delivery times are estimates and may vary depending on availability and logistics.
6. Transfer of Ownership and Risk
Ownership of the equipment transfers to the Client only after full payment has been made.
Risk transfers at the moment of delivery or collection.
7. Warranty
Second-hand equipment is generally sold "as is", without warranty, unless explicitly stated otherwise in writing.
Any warranty provided will be specified in the sales documents.
8. Returns and Complaints
Due to the nature of the products, returns are not accepted, except where required by law or agreed contractually.
Complaints must be submitted in writing within 48 hours from receipt.
9. Liability
The Seller shall not be liable for:
improper use of the equipment
indirect losses or consequential damages
10. Legal Compliance
The Client is responsible for complying with all local laws and regulations regarding the use of the equipment.
11. Governing Law
This contract shall be governed by the laws of the Netherlands.
12. Dispute Resolution
Any dispute shall first be resolved amicably, and if not possible, shall be submitted to the competent courts in the Netherlands.
13. Final Provisions
The Seller reserves the right to modify these Terms and Conditions without prior notice.
